Status of Ketubah in Divorce

The Ketubah – Its Meaning, Legal Validity, and Status in Divorce Proceedings

The ketubah is the document most associated with the wedding ceremony and the consecration.

The origin of the requirement for a ketubah is in the Torah, which prohibits living together without a ketubah, and the ketubah was later amended by the sages of the Mishnah, with the aim of protecting women from expulsion by their husbands.

The reason for this is that according to the ketubah, the one who divorces his wife is required to pay her a significant amount of money.

The content of the ketubah states that the husband undertakes to support and respect the wife, and it details the amount that the husband is required to pay the wife if she is divorced by him.

The ketubah is an integral part of the religious marriage and is signed in the presence of two witnesses, who must also be present when it is delivered to the woman.

At the conclusion of the Kiddushin ceremony under the canopy, the ring symbolizes the fact that the husband owes his wife the amount of money inscribed in the ketubah..

At the same time, the husband is not required to fulfill the other obligations detailed in the ketubah, as these will become mandatory for him at the time the ketubah is delivered.

In the modern era, the minimum amount in the ketubah is the intended groom’s annual salary.

There are also those who commit to much higher amounts, sometimes due to a lack of knowledge about the meaning of this document in the event of Divorce.

The legal status of the ketubah

The ketubah itself is a legal document with all that this implies, however, the legal reality in the State of Israel has emptied the ketubah of its legal content.

The Financial Relations Law of 1973 regulates property issues in the relationship between spouses, and in today’s reality, the wife only rarely demands the amount that the husband pledged in the ketubah.

Although the ruling considers the ketubah a legally binding document, the liability will be decided according to the rules of Jewish law.

The rulings of the rabbinical courts regarding the ketubah have changed over the years – in the past, it was ruled that if the amount stipulated in the ketubah is too high and the husband is unable to pay, he may Home Rabbinic Law Reduce the amount of the ketubah.

In another case, due to the husband’s infidelity, the husband was required to pay his wife the amount stipulated in the ketubah, which was one million shekels, because the court did not accept the husband’s argument that he had written the amount in the ketubah when he was possessed by a spirit of foolishness.

Exemption from paying the ketubah and entitlement to receive the ketubah

According to Jewish law, there are cases in which a husband has the right not to pay his wife the amount specified in the ketubah.

These include circumstances such as concealing health problems that the woman was aware of at the time of marriage; infidelity; refusal to have sexual relations with the husband; an act of ugliness that in itself does not provide direct proof of the wife’s infidelity; the husband’s failure and failure to fulfill a commandment or the wife’s leaving the home.

On the other hand, there are cases in which religious law establishes a woman’s right to her address, such as infidelity, inappropriate behavior by the husband, or medical problems and problems with sexual function.

In order to maintain the right to receive the ketubah, there are Lawyers The wife is advised to express her willingness to have a housewarming ceremony, submit the ketubah for review to ensure that there are no mistakes, avoid behavior that could lead to the denial of eligibility, and document the husband’s behavior that could obligate him to pay.
